The ninth circuit court has upheld a prohibition on deploying national guard in Portland, Oregon, following a latest legal decision.

Appeals Court Concurs to Rehear Case

The ninth circuit court of appeals ruled on Tuesday that it would reexamine the legal dispute concerning the president’s authority with an expanded panel of 11 judges. The judicial body also overturned a earlier ruling from a three-judge panel that had supported the federal government.

Legal Saga Over Troop Deployment

This legal directive represents the most recent turn in a protracted court case over whether the administration has the legal right and valid reason to deploy national guard forces in the city. Approximately 200 federalized guard members have been in uncertainty since late September when the mobilization attempt was started in due to months of protests.

Differing Viewpoints

The federal government has claimed that federal officials at the ICE facility in the southern part of the city were under attack, while city and state officials assert that local officers have control of the circumstances.

Contrary to characterizations of Portland as “war ravaged”, locals have been sharing footage of lush hiking trails and a vibrant culinary culture, and planning events such as an protest bicycle event against the “militarization of our city”.

Court Proceedings

The Tuesday ruling came after a federal judge in Portland issued two temporary restraining orders this period – one blocking the federalization of the state troops, and another stopping the deployment of any national guard troops in the state, after efforts to evade the first order by calling up troops from California.

On the previous day, the ninth circuit panel had put the first ruling on hold – permitting command of 200 Oregon national guard – but the second ruling stayed effective, preventing the actual deployment of the forces.

En Banc Review

The Tuesday decision means the issue will be heard “en banc” – with all decisions under review simultaneously – by a panel of 11 judges.

“This decision demonstrates that facts are important and that the judicial system are striving to ensure government responsibility. The constitution restricts the president’s power, and local populations cannot be treated as a training ground for expansive government power,” said the legal representative in a statement.

“The court is sending a clear message: the president cannot send the armed forces into American urban areas without cause. We will continue defending Oregon’s laws, values, and sovereignty as this case progresses and our fight continues in the judicial system.”
